Dismissal of the lawsuit filed by Facebook and WhatsApp with the competition authority – Last Minute Technology News

After Facebook announced the conditions for the use of WhatsApp user data in Turkey for other services on February 8, 2021, the competition authority issued an injunction on these social media platforms on January 11, 2021.

As a result, Facebook and WhatsApp filed a lawsuit for suspension of enforcement, claiming the injunction had been issued without sufficient research on the update.

The petition alleged that the interim injunction issued by the institution was based on factual errors, that the injunction had failed to comply with legal grounds, that the allegation of excessive collection and disclosure of information was not true, that the data update was issued since 2016 became that the established lawsuit was unlawful and that the injunction was requested to be set aside.

ADMINISTRATIVE COURT REJECTED THE CASE

The 4th Ankara Administrative Court handling the case rejected the application for annulment.

The court justified its decision as follows:

“As a result of the analysis of market forces and the market structure of Facebook and other affiliates, it is possible that the aforementioned practices could cause serious and irreparable damage until the final decision to be taken as a result of the investigation the company in question is still ongoing and a new decision can be made on this issue. With this in mind, it has been determined that there is no violation of the law or law in the form of an injunction in the injunction. Facebook notifies all users who accept the terms in Turkey or who do not accept the information by receiving the information that they accept the new terms for have stopped sharing data.
